The high cost of the review phase of electronic discovery has extended the outsourcing of document review and coding beyond the borders of the United States, with document review projects being handled by teams located in India. These practices promise great cost-savings, but have raised many questions in connection with lawyers’ ethical obligations, privilege and confidentiality concerns, and more fundamentally, about the effectiveness of the review in the context of overall litigation strategy. The panel of experts consisting of clients, outside lawyers’, and providers of outsourcing services will identify and debate these issues on the cutting edge of electronic discovery cost-containment strategies.
